Walmart settles with slip-and-fall plaintiff

STARKE‑ Walmart reached an out-of-court settlement with a woman just before the case was to go to trial, according to the Bradford County clerk’s office.

Attorneys for Linda Jones said their client slipped on a grape in the bread aisle of the retailer’s Starke location in August 2019. The details of the settlement were unavailable.

According to court papers, the plaintiff claimed two witnesses saw Jones slip on the crushed grape and that a Walmart employee admitted to seeing some kind of residue on the floor after the incident. Walmart claimed in court papers that the plaintiff was negligent by failing to watch where she was going and failing to pay attention to her surroundings. “Without the plaintiff’s negligence,” lawyers for the retailer wrote in a pre-trial statement, “she would have seen the grape on the floor and not stepped on it.”
