A man who ran out of a probation office lobby rather than giving a urine sample for a drug test was sentenced to 120 days in jail.

Michael Rodney McCarter III was first arrested in March after Starke police pulled him over for a faulty tag light and discovered his license had been suspended. Police also found methamphetamine and drug paraphernalia in the car, in addition to three passengers, but did not arrest McCarter for the drugs.

A judge sentenced the 24-year-old to 12 months’ probation and ordered him to undergo drug testing.

A probation officer wrote in a violation report that after missing one appointment with a probation officer, the defendant admitted to smoking marijuana during a subsequent August appointment and was told to submit a urine sample for the test. “The offender stated he needed to wait because he did not know he would have a drug test,” wrote an officer in the violation report. McCarter was told to wait in the lobby until he was ready to give the sample, but he was gone when the officer walked to the lobby to get him. When a probation officer went to his home, the resident told the officer McCarter had moved out, adding another violation since the offender did not get permission to change his residence.
