The Department of Environmental Protection gives notice of its determination pursuant to section 120.542, Florida Statutes, in File No. MMR-137482-029 to grant a variance to The Chemours Company FC, LLC, from Rule 62C-37.008(11)(b), Florida Administrative Code (F.A.C.) and Section 378.601(4)(i), Florida Statutes (F.S.), in order to delay reclamation of 523 acres of land mined for heavy minerals to allow coordination with the Suwannee River Water Management District, located in Sections 1 and 12, Township 6 South, Range 22 East; Section 6, Township 6 South, Range 23 East; Section 31, Township 5 South Range 23 East; and Section 24, Township 5 South, Range 22 East. A person whose substantial interests are affected by the Department’s action may petition for an administrative proceeding(hearing) under Sections 120.569 and 120.57, F.S. Pursuant to Rule 28-106.201, F.A.C., a petition for an administrative hearing must contain the followinginformation:
(a) The name and address of each agency affected and each agency’s file or identification number, if known;

However, any person who has previously asked the Department for notice of this agency action may file apetition within 21 days of receipt of such notice, regardless of the date of publication. The failure to file a petition within the appropriate time period shall constitute a waiver of that person’s right to request an administrative determination (hearing) under Sections 120.569 and 120.57, F.S., or to intervene in this proceeding and participate as a party to it.
