STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION NOTICE OF CONSENT ORDER

The Department of Environmental Protection (“Department”) gives notice of agency action of entering into a Consent Order with The Chemours Company FC, LLC pursuant to section 120.57(4), Florida Statutes.  The Consent Order addresses the exceedances for Total Recoverable Iron at 5222 Treat Road, Starke, Florida 32091.  The Consent Order is available for public inspection during normal business hours, 8:00  a.m. to 5:00 p.m., Monday through Friday, except legal holidays, at the Department of Environmental Protection, Northeast District, 8800 Baymeadows Way West, Suite 100, Jacksonville, Florida 32256.  

Persons who are not parties to this Consent Order, but whose substantial interests are affected by it, have a right to petition for an administrative hearing under sections 120.569 and 120.57, Florida Statutes. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition concerning this Consent Order means that the Department’s final action may be different from the position it has taken in the Consent Order.  

The petition for administrative hearing must contain all of the following information:  

  1. a) The name and address of each agency affected and each agency’s file or identification number, if known;
  2. b) The name, address, any e-mail address, any facsimile number, and telephone number of the petitioner, if the petitioner is not represented by an attorney or a qualified representative; the name, address, and telephone number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests will be affected by the agency determination;
  3. c) A statement of when and how the petitioner received notice of the agency

decision; 

  1. d)A statement of all disputed issues of material fact. If there are none, the  petition must so indicate;
  2. e) A concise statement of the ultimate facts alleged, including the specific facts

the  petitioner  contends  warrant  reversal  or  modification  of  the  agency’s proposed action; 

  1. f) A statement of the specific rules or statutes the petitioner contends require reversal or modification  of  the  agency’s  proposed  action,  including  an explanation of how the alleged facts relate to the specific rules or statutes; and
  2. g)A statement of the relief sought by the petitioner, stating precisely the action petitioner wishes the agency to take with respect to the agency’s proposed action.

The petition must be filed (received) at the Department’s Office of General Counsel, 3900 Commonwealth Boulevard, MS# 35, Tallahassee, Florida 32399-3000 or  received via electronic correspondence at [email protected], within 21  days of receipt of this notice.  A copy of the petition must also be mailed at the time of filing to the District Office at Northeast District, 8800 Baymeadows Way West, Suite 100, Jacksonville, Florida 32256.  Failure to file a petition within the 21-day period  constitutes a person’s waiver of the right to request an administrative hearing and to participate as a party to this proceeding under sections 120.569 and 120.57, Florida Statutes.  Within 10 days after filing a petition, a person whose substantial interests are affected by this Consent Order may choose to pursue mediation as an alternative remedy under section 120.573, Florida Statutes.  Choosing mediation will not adversely affect such person’s right to an administrative hearing if mediation does not result in a settlement.  Additional information about mediation is provided in section 120.573, Florida Statutes and Rule 62-110.106(12), Florida Administrative Code.

Notice is hereby given that pursuant to Chapter 373, Florida Statutes, the following application for permit was received on February 27, 2026:

REQUEST FOR PROPOSALS FOR

INDEPENDENT AUDITING SERVICES

The City of Lawtey, Florida is requesting submittals from independent certified public accountants to provide auditing services in accordance with generally accepted governmental auditing standards for the 2025-2026 fiscal year, and possibly up to an additional four years, providing annual performance is satisfactory. The successful submitter shall provide all labor and materials required to conduct a financial audit of the basic financial statements for all funds, including grants, of the City of Lawtey.

Proposals should be submitted to City of Lawtey, P.O. Drawer G, Lawtey, FL. 32058 or delivered to 2793 Lake St., Lawtey, Fl. 32058 on or before March 20, 2026, at 4p.m. (EST)

AUDITING SERVICES CONTRACT DURATION

The term of this auditing service contract shall be for one (1) year and may be extended for up to four (4) additional years to coincide with yearly fiscal starting and ending dates provided annual performance is satisfactory.

SCOPE OF SERVICES

The following scope of services is merely representative of the duties that shall be performed by the auditing firm. Any reports or requirements either required by state law or by the City of Lawtey should be presumed to be included in this scope of services. Auditing duties shall include services in conformance with all Statutes and Rules of the State of Florida, which regulate auditing practices and reporting procedures and deadlines. The final audit shall contain a written opinion, based upon the Auditor’s findings, that the agencies financial position and results of operation and changes in financial position have been fairly presented in conformance with generally accepted accounting principles; a determination as to whether or not operations have been conducted incompliance with applicable laws, policies, and/or regulations; and a Management Lette reflecting the Auditor’s comments and recommendations in conformity with Rules of the Auditor General of Florida.

The Auditor will be responsible for preparation of audited financial statements which shall include, but not be limited to, the:

  • Basic Financial Statements
  • Combining and Individual Fund Statements
  • Reports on internal control of financial reporting and on compliance in accordance with Government Auditing Standards
  • Management letter required by Rules of the Auditor General
  • Required supplementary information
  • Federal Single Audit Report (if applicable)
  • State Single Audit Report (if applicable)

In addition, the Auditor shall complete and submit the Florida Annual Financial Report.

The Auditor shall be responsible for conducting at a minimum an examination of the financial statements of the City funds and account groups:

  • General Fund
  • Enterprise Fund
  • Long-term Debt schedules
  • General capital assets
  • Grants-Compliance with Single Audit Requirements (if applicable)

AUDITING STANDARDS

  • Generally accepted auditing standard adopted by the American Institute of Certified Public Accountants.
  • All provisions of Federal/State statutes and regulations applicable to local government audits.
  • Rules of Auditor General Florida
  • Generally accepted standards of governmental accounting, auditing, and financial reporting (GAAFR).

AUDITING REPORTS/COMPLIANCE

  • A draft of the Audit Report and Management Letter shall be made available to the City at the time of the exit conference.
  • A final Audit Report and at least 6 bound copies and 1 pdf shall be submitted to the City not later than the date designated by the City of Lawtey.
  • In the final Audit Report and/or Annual Report are deemed to be “not in compliance” by the State following submission thereto, the Auditor shall bring such report(s) into compliance without additional compensation from the City.

STAFF ASSISTANCE

The City staff and Accounting Consultant will be responsible for:

  • Closing out the financial records for the year end, including performing reconciliations of significant accounts and making appropriate accruals to the financial records.
  • Preparing paperwork that backs up the significant balances in the general fund.
  • Running requested reports for the Auditor in either pdf or Excel formats.
  • Promptly addressing all Auditor inquiries.
  • Updating the fixed asset schedules.
  • Provide office space for the Auditor to efficiently conduct the audit.

DETAILED PROPOSAL

  • General requirements should present qualifications, competence and the capacity of the firm to undertake an independent audit of the City of Lawtey. The proposal should demonstrate the qualifications of the firm and staff to be assigned to this engagement. It should also specify the audit approach that will meet the required standards.
  • A copy of your License to practice in Florida should be included indicating that the firm and all assigned key personnel staff are properly licensed to practice in Florida.
  • The proposal shall include the size of the firm’s governmental auditing staff. The firm shall also provide information regarding qualifications and experience with governmental auditing.
  • The firm shall provide information on the results of any federal or state desk reviews of field reviews of its audits during the past 5 years. In addition, the firm shall provide information on the circumstances and status of any disciplinary action taken or pending against the firm during the past 5 years with state regulatory bodies or professional organizations.
  • The firm shall identify the principal supervisory and management staff who would be assigned to the engagement and indicate whether each person is licensed to practice as a certified public accountant in Florida.
  • The firm shall list the most significant engagements performed in the last 3 years that are similar to the engagement described in the request, with other Government Entities.
  • The proposal should set forth a work plan with a specific Audit Approach to perform the required services, including approximate time frames.
  • The firm shall include a cost and fee schedule to include the audit and AFR totals.

REQUEST FOR QUALIFICATIONS RESPONSE CRITERIA

  • Must be received by March 20, 2026, at 4 p.m.
  • Title page should include the firm’s name, address, telephone number of a contact person and the date of the proposal.
  • Assurance and ability for the firm to commence audit by April 1st each year and deliver a draft within 80 days and a final report within 90 days.
  • A brief statement should be included with the firm’s background, organization and size.

  • Proposals must be submitted in a sealed envelope clearly marked “PROPOSALS FOR INDEPENDENT AUDITNG SERVICES” on the outside of the envelope.
